General Terms and Conditions

These general terms and conditions concern IT Remote software, sold online at https://itremote.com/ or by direct contact with the company IT REMOTE SAS.

The customer declares that they have read the following provisions before ordering the products. It is the exclusive responsibility of each customer to define their needs, choose the appropriate hardware and software and ensure the compatibility of the products purchased. Placing an order implies full acceptance of these general terms and conditions by the customer, as well as full legal capacity to commit to these general terms and conditions. We may modify these general terms and conditions at any time, provided that we publish these modifications on our website.

1. Prices

The prices of our products are shown in euros and US Dollars excluding taxes and VAT. Companies from the European Union must provide an intra-Community VAT number in order to be invoiced exclusive of VAT. In the absence of this number, invoices will be issued inclusive of VAT. Prices in USD are given as an indication, the reference prices are in euros.

For all products shipped outside the European Union and French overseas territories, our prices are exclusive of tax. Customs duties, other local taxes or import duties, or State taxes may be payable. These duties and sums are not the responsibility of IT REMOTE. They shall be charged to the customer.

IT REMOTE reserves the right to change its prices at any time, but the products will be invoiced on the basis of the prices in force at the time the order is registered, subject to availability.

Price information is subject to change and is given as an indication only.

2. Orders

All orders, regardless of their origin, are payable in euros.

Orders are placed online on the website or, failing that, by post or e-mail.

- On the internet:  https://itremote.com/, orders placed on the website will be acknowledged by e-mail. It is the customer's responsibility to check the order confirmation and to inform IT REMOTE immediately of any error.

- By e-mail: Send the order form to order@itremote.com, the order will be processed upon receipt of payment.

IT REMOTE reserves the right to cancel or refuse any order from a customer with whom there is a dispute over payment for a previous order.

3. Confirmation

On our website, when you click on the 'Confirm' button after the order process, you declare that you accept all these general terms and conditions, in full and without reservation.

The data recorded by IT REMOTE constitutes proof of all transactions between IT REMOTE and its customers. The data recorded by the payment system constitutes proof of the financial transactions.

4. Availability

Our product and price offers are valid as long as they are visible on the website. If a product is not available after you have placed your order, we will inform you by e-mail or by post as soon as possible.

You will then be asked if you wish to:

- Either cancel your order and receive a refund

- Or receive a credit note for the same amount on your next purchase

- Or wait for the product you ordered to become available (in this case, you will be given a new delivery time as an indication)

Refunds shall be paid by bank transfer only.

5. Delivery

The products are delivered only by e-mail by sending a licence file containing a license key. The software can be downloaded from the website in a limited version and will be unlocked by the key.

At the time of ordering, you must provide a valid e-mail address. IT REMOTE will do its utmost to ensure that you receive the e-mail containing the software licence key and the software download link as soon as possible.

The customer shall ensure that their spam filter does not block the messages sent by our automated system.

Any order delivered outside the European Community may be subject to taxes and customs duties. These taxes and duties are payable by the customer and are their sole responsibility.

6. Payment

There are various payment methods available to you:
- Either by bank card: Visa, Eurocard/Mastercard/Amex. The card is debited when the order is placed.
- Or by PayPal
- Or by bank transfer.

Transfers must be made using the following references:

The products remain the property of IT REMOTE until the price has been paid in full, particularly in the event that the payment method is rejected.

7. Security

To avoid any risk of bank card fraud, IT REMOTE uses a secure payment system that complies with the standards of SSL, the most secure encryption protocol and currently the most widely used.

Your bank details are directly encrypted and routed to BNP PARIBAS’ e-transaction body, without going via our site. IT REMOTE never receives the bank authorisation. It is directly managed by the bank. IT REMOTE never stores any banking information.

8. The licence to use

The user must read the licence before using the software. Requesting the activation code constitutes acceptance of the terms of the licence to use.

You may not assign or transfer your rights to the software or authorise the copying of all or part of the software onto another user's computer.

You may only transfer your rights to use the software to another person if you waive your right to use the software yourself and uninstall it from your computer including its activation key. The beneficiary must accept the provisions of this contract.

You must inform IT REMOTE by e-mail and provide the beneficiary's contact details.

Intellectual Property

All texts, comments, works, illustrations and images contained in the IT REMOTE websites are reserved under copyright law and intellectual property law for the whole world.

In this respect, and in accordance with the provisions of the French Intellectual Property Code, only private use is authorised. Any other use constitutes an infringement and is punishable under the French Intellectual Property Code, unless prior authorisation has been granted by IT REMOTE.

9. Liability

The products offered comply with the applicable French legislation. IT REMOTE cannot be held responsible in the event of non-compliance with the legislation of the country where the products are delivered.

IT REMOTE shall not be held responsible for non-performance of the concluded contract in the event of stock shortages or unavailability of the product, force majeure, disruption or total or partial strike, in particular by the communications services. In addition, IT REMOTE cannot be held liable for any “damages and interest” for any reason whatsoever.

10. Applicable law - Disputes

The language of this contract is the French language. In case of dispute and recourse to the courts, the courts of Aix en Provence shall have sole jurisdiction.

11. Personal informations

IT REMOTE undertakes not to divulge to third parties any information provided by the client.

IT REMOTE only collects data that is strictly necessary for the proper processing of orders. The information requested from the customer is necessary for the processing of their order and is intended for use by the departments of IT REMOTE. In application of Law n° 78-17 of 6 January 1978, the customer has the right to access information concerning them.

This information may be communicated to the customer on request and may be rectified in the event of error or modification.
